If both spouses agree to everything in a divorce and are willing to sign all of the divorce papers, you can file for divorce together. Usually no hearing is required, and the divorce is granted within a few weeks of turning in your paperwork.

To file a joint divorce, you and your spouse must agree on ALL of the following:

• How to divide any property
• How to divide any debts
• Whether either of you will pay alimony and if so, for how long
• Whether either of you want a former name restored (if applicable)
• If you have children, your agreement as to custody of the minor children, visitation schedules, and holiday visitation
• If you have children, your agreement as to child support and who should provide health insurance for the children
